These Terms of Service ("Terms") govern your access to and use of the services provided by Twarix, doing business as Serv ("Serv", "we", "our", or "us"), including our website and incident response platform (the "Services"). By creating an account or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
Serv provides an AI-assisted incident response platform that integrates with your existing chat tools, monitoring systems, code repositories, and paging providers. The Services allow engineering teams to manage production incidents from a single channel with AI support available on request.
We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice. For material changes that affect paid plans, we will provide at least 30 days notice.
You must provide accurate and complete information when creating an account and keep your account information up to date. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
You may not share your account credentials with others or allow multiple individuals to access the Services through a single account. You must notify us immediately at security@serv.so if you suspect unauthorised access to your account.
We may suspend or terminate accounts that violate these Terms or that we reasonably suspect are being used for fraudulent or abusive purposes.

We reserve the right to investigate and take appropriate action against violations, including suspending or terminating access without notice.
The Services connect to third-party platforms (such as Mattermost, Slack, GitHub, PagerDuty, Sentry, and LaunchDarkly) based on credentials and permissions you provide. You are responsible for ensuring that your use of those integrations complies with the applicable terms of service for each platform.
Serv is not responsible for the availability, accuracy, or reliability of third-party services. Disruption of a connected integration does not entitle you to a refund or service credit unless it results from a failure on our part.
Paid plans. Access to paid features requires a paid subscription. Subscriptions are billed in advance on a monthly or annual basis depending on the plan you select.
AI overage. On Startup and Team plans, AI queries beyond your monthly included allowance are billed at $0.10 per query and invoiced at the end of each billing period. You may set a hard cap on overage in your workspace settings.
Payment. You authorise us to charge your payment method on file for all fees incurred. If payment fails, we will notify you and may suspend access to the Services after a reasonable grace period.
Refunds. We do not offer refunds for partial months. If you cancel a paid plan, your subscription remains active until the end of the current billing period.
Price changes. We will notify you at least 30 days before any price increase takes effect. Continued use of the Services after the effective date constitutes acceptance of the new pricing.
Our IP. The Services, including all software, design, and content, are owned by Serv and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets.
Your data. You retain ownership of all data you bring into or generate through the Services, including incident channel content, postmortems, and runbooks. You grant us a limited licence to process your data as necessary to provide the Services.
Feedback. If you provide suggestions, ideas, or feedback about the Services, you grant us a perpetual, royalty-free licence to use that feedback without any obligation to you.
Each party agrees to keep confidential any non-public information disclosed by the other party in connection with the Services that is marked as confidential or that should reasonably be understood to be confidential given the context of disclosure.
This obligation does not apply to information that is or becomes publicly known through no fault of the receiving party, is independently developed without reference to the confidential information, or is required to be disclosed by law.
We provide the Services on an "as is" and "as available" basis without warranty of any kind, express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free from harmful components, or that any defects will be corrected.
To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by applicable law, Serv's total liability to you for any claims arising from or related to these Terms or the Services shall not exceed the amount you paid us in the 12 months preceding the claim.
In no event shall Serv be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or loss of goodwill, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to indemnify and hold harmless Serv and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any third-party rights.
You may cancel your account at any time through workspace settings. Cancellation takes effect at the end of your current billing period for paid plans.
We may terminate or suspend your account immediately if you violate these Terms, if required by law, or if we discontinue the Services. Upon termination, your right to use the Services ceases immediately. We will provide a reasonable opportunity to export your data unless termination results from a violation of these Terms.
These Terms are governed by the laws of the Netherlands without regard to conflict of law principles. Any dispute arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Amsterdam, Netherlands.
Before initiating formal legal proceedings, the parties agree to attempt to resolve disputes informally by contacting us at legal@serv.so. We will try to resolve the dispute within 30 days.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website at least 14 days before the changes take effect. If you do not agree to the updated Terms, you must stop using the Services before the effective date. Continued use constitutes acceptance.
Entire agreement. These Terms, together with our Privacy Policy and any applicable order forms, constitute the entire agreement between you and Serv regarding the Services.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver. Failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
